The Services capture, present and distribute authoritative information on behalf of, and as received from, Transnomis clients and users; and in some case their clients, users and members.
The Services may also capture and present authoritative content sourced from open and other trusted sources.
The Services may also capture and present non-authoritative information, which will be identified to the source of that information. E.g. Waze.
The notification features of the Services were designed for distribution lists of one to one hundred, and not as public or mass notification service.
The Services may continue to evolve, and without notice.
The Services are hosted in Canada.
The Services are web services, and are developed for use within popular web browsers. Users are encouraged to have two browsers installed on their devices, so that if one browser is not functioning properly, you can use another browser. Primary testing is with the Chrome browser.
Use of the Services
You may use the Services for your organization’s professional purposes for the period your organization has purchased the Services for, the period your organization is eligible to use such Services, or for the period Transnomis has granted your organization access to the Services.
You may not redistribute or resell the content found in the Services, without the written approval of Transnomis.
You may show people the Services to other organizations in support of your professional duties, or as an introduction to the Services; with the understanding that use by other organizations is subject to fee.
You may embed the Municipal511 public website (www.Municipal511.ca) and Municipal511 Permit landing page within your website, providing you present the full page, including the copyright statement.
The navigation features are not designed to be a replacement for information provided by persons, signs, lights, and other means.
Service Level Commitments
Transnomis takes all reasonable steps to make the Service available to End-Users at least 99.9% of the time during any 30 day period, exclusive of scheduled maintenance.
Transnomis provides support by email, and or telephone or web meeting service. You are encouraged to use email@example.com, which is sent to the Product Manager and Help Desk.
Transnomis aims to provide an initial response to all enquiries of severe issues within 1 hour and follow-up on a best-efforts basis. Severe issues include:
• Server down / not accessible
Transnomis aims to provide an initial response to all major issues within 4 hours and follow-up on a best-efforts basis. Major issues include:
• Certain Software features are not accessible and returns persistent error messages, preventing normal operations
• Notification issues
• Server becomes unresponsive (e.g., takes over 3 seconds to load a page)
• Potential loss of Data and external system intrusion / hacking
Transnomis aims to provide an initial response to all minor issues within 24 hours and follow-up on a best efforts basis. Minor issues include:
• Certain Service features not accessible or working correctly but can be worked around and not prevent normal operations;
• Administrative functions of Service not accessible or returns persistent error messages.
• Browser issues – certain feature working on one browser but not another.
Transnomis has setup automated web application monitoring service in order to ensure the availability of the Services to you. Should the system fail to respond, automated email notifications are sent to the Transnomis support team.
Warranties/Disclaimer/Limitations of Liability
There is no other guarantee of Services other than what is stated in the Service Level Commitments.
Transnomis assumes no responsibility for the accuracy or suitability of the content provided in the Services.
Transnomis will not be liable for any direct or indirect losses, damages or costs arising from the use of the Services. You hold Transnomis harmless for your use of the Services.
The Services are provided on an “as is” basis.
Transnomis is not obligated to enforce the TOU.
Your organization is obligated to pay for the services used by your organization; unless paid for by another party or offered without fee by Transnomis.
Your organization is obligated to pay Transnomis for use of the services that exceeds that which were paid for.
You are obligated to support the integrity of the Services to the benefit of all Transnomis clients, and their stakeholders. The accuracy and timeliness of your content is essential.
Grant of Rights
You grant Transnomis a worldwide, transferable, irrevocable and perpetual right to use, copy, modify, process, compile, archive, incorporate, display, distribute and/or use, in any way Transnomis sees fit at its sole discretion, any or all content entered by your organization into layers labeled as “Public”, with the understanding that Transnomis may distribute such “Public” information for the greater good of all stakeholders, to navigation companies, provincial agencies, third party application suppliers, and others.
If you are a Waze Connected Citizens Partner, and Transnomis is providing and retrieving Waze data for your organization, you have obligations to Waze when using this service.
You are under no obligation to use the Services, and you may therefore terminate the use of the Services at any time, and for whatever reason, without notice. You are expected to remove any items posted that have not yet expired.
Transnomis reserves the right to discontinue, change or modify features of the Services, in part or entirely, at its sole discretion, and without notice.
Transnomis may change or modify this TOU, in part or entirely, at its sole discretion, and without notice.
User feedback and suggestions are encouraged, with the understanding that they may be used by Transnomis freely, and without compensation or attribution.
This TOU is subject to interpretation under the laws of Ontario Canada. Any dispute, claim or controversy arising will be subject to the laws and courts of Ontario Canada.
Should you file action against Transnomis relating to the Services, you must do so within 2 months of the day you became aware of the cause for such action.
Transnomis’ liability in any dispute will not exceed the amount paid for the Services.
